Slim Chickens Franchise Lawsuit Grows as EEOC Case Emerges
Slim Chickens faces renewed legal pressure as a franchisee prepares to refile claims while a separate operator fights an EEOC harassment lawsuit.
Slim Chickens Franchisee Plans New Lawsuit as EEOC Case Adds Legal Pressure
Slim Chickens is facing renewed legal attention as one franchise group prepares to bring its claims against the fast-casual chicken brand back to court, while a separate franchise operator has been sued by the U.S. Equal Employment Opportunity Commission.
The two cases are unrelated and involve different franchisees, but together they put a spotlight on franchise operations, disclosure practices and workplace management within the growing Slim Chickens system.
R-Solution Plans to Refile Lawsuit Against Slim Chickens
R-Solution, a Midwest franchise group led by Gary Grewe, intends to refile its lawsuit against Slim Chickens Development Company after its earlier case was dismissed without prejudice.
The franchisee group is expected to return with additional Slim Chickens operators joining the case as plaintiffs.
R-Solution and affiliated companies originally filed their lawsuit in Arkansas in June 2025. The group operates 10 Slim Chickens restaurants across Illinois, Missouri and Kentucky and has said it invested more than $15 million in developing its franchise business.
Its original complaint accused Slim Chickens of fraud, constructive fraud and breach of contract.
The franchise group alleged that the business opportunity presented to prospective franchisees did not accurately reflect the financial realities operators could face after opening restaurants.
Slim Chickens has denied the allegations.
Franchisee Raises Concerns About Financial Performance
A major part of R-Solution's complaint focused on financial performance information used to promote the Slim Chickens franchise opportunity.
The franchisee alleged that stronger-performing restaurants were emphasized in ways that could create unrealistic expectations about average restaurant sales and profitability.
R-Solution said its own restaurants performed below the expectations it developed while evaluating the opportunity. According to its lawsuit, the group invested millions of additional dollars to support operating expenses and keep restaurants running.
The franchisor has challenged that characterization and has previously argued that the lawsuit was an effort by an underperforming franchisee to shift responsibility for its own business results.
An earlier court ruling dismissed allegations tied specifically to certain average-unit-volume fraud claims. The broader litigation later ended without prejudice, which allows the plaintiffs to pursue the matter again.
R-Solution now appears ready to do exactly that.
Adding other franchisees to a new complaint could become an important development. A dispute involving one ownership group can be framed as an isolated conflict. Similar allegations from multiple independent operators could create a more complicated legal challenge for a franchisor.
Any new complaint will ultimately determine which claims the expanded franchisee group intends to pursue.
Food Quality and Supplier Issues Were Also Raised
The earlier R-Solution lawsuit went beyond financial performance.
The franchisee group also challenged changes involving chicken products, suppliers, royalties and development rights.
Among its allegations, R-Solution claimed that Slim Chickens moved to frozen chicken while continuing to emphasize freshness in its brand positioning. It also questioned how some of the chain's dipping sauces were described to consumers.
The lawsuit further alleged that restrictions involving approved suppliers increased restaurant costs and that the franchisor rejected alternative suppliers that R-Solution believed could lower expenses.
Royalty calculations were another point of disagreement.
R-Solution claimed operators were required to pay royalties on certain sales amounts that did not fully reach franchisees because of discounts or third-party delivery expenses.
These remain allegations made by the franchisee group and have not been established as findings against Slim Chickens.
Slim Chickens has consistently disputed the accusations and defended its franchise model.
Separate EEOC Lawsuit Targets South Dakota Franchisee
While the R-Solution dispute involves the franchisor, another legal matter centers on a completely separate Slim Chickens franchise operator.
The EEOC filed a federal lawsuit against TNT Chicken Inc., which operates Slim Chickens restaurants in the Sioux Falls, South Dakota, market.
The federal agency alleges that a Black female employee experienced racial and sexual harassment while working at one of the restaurants.
According to the EEOC complaint, the alleged conduct began in November 2023 and included racial comments, sexual remarks and threats of physical violence from a shift lead.
The agency alleges that the employee reported the conduct to management but the company failed to stop it.
The EEOC further claims the employee later experienced retaliation, including reduced working hours, after raising concerns.
The employee eventually resigned, according to the agency.
TNT Chicken, rather than Slim Chickens Development Company, is the defendant in the federal employment case.
TNT Chicken Is an Experienced Multi-Unit Operator
TNT Chicken has been associated with Slim Chickens for several years and has operated multiple restaurants in the Sioux Falls area.
The group has also pursued expansion across eastern South Dakota and northwest Iowa.
That makes the EEOC lawsuit particularly notable from a franchise management perspective. Multi-unit franchisees often employ large workforces and operate with significant independence, but incidents at individual restaurants can still affect public perception of the broader franchise brand.
Employment practices are generally managed by individual franchise operators rather than the franchisor, depending on the structure of the franchise relationship.
The EEOC's lawsuit seeks relief under federal employment discrimination law and remains an allegation unless established through the court process or resolved by the parties.
Slim Chickens Continues Expanding
The legal developments come while Slim Chickens continues pursuing franchise growth in the United States and internationally.
Founded in Fayetteville, Arkansas, the chicken concept has expanded significantly through franchising and has attracted experienced multi-unit restaurant operators.
The brand has also introduced smaller development formats, including drive-thru-focused restaurants, as it looks for additional ways to enter new markets.
That growth makes franchisee economics and franchise system oversight increasingly important.
Rapid expansion depends not only on signing development agreements but also on helping existing operators build sustainable businesses, maintaining consistent standards and protecting the customer and employee experience across independently operated locations.
For prospective franchisees, the R-Solution dispute is another reminder of why reviewing a franchise disclosure document is only one part of due diligence.
Speaking with current and former franchisees, studying unit-level economics, understanding supplier requirements and building conservative financial projections can provide a clearer picture of what ownership may actually look like.
For franchisors, both cases illustrate different risks that can emerge inside a large franchise network.
One concerns the relationship between a franchisor and its franchisees. The other concerns how an independent franchisee manages employees.
As R-Solution prepares to bring its case back to court with additional operators potentially involved, the Slim Chickens franchise lawsuit will remain one of the more closely watched disputes involving the fast-growing chicken franchise sector.|
